These Terms & Conditions apply to all purchases made from Northern Comfort Furniture LTD (“we”, “us”, “our”) via our website, telephone, eBay, showroom, or any other sales channel.
By placing an order with us, you agree to be bound by these Terms & Conditions.

We manufacture and supply furniture within the United Kingdom.
2. Orders
2.1 All orders are subject to acceptance and availability.
2.2 After placing an order, you will receive an order confirmation email. This confirmation does not constitute legal acceptance of the order. A binding contract is formed only once your order has been dispatched.
2.3 We reserve the right to refuse or cancel any order at our discretion. If payment has already been made, a full refund will be issued.
2.4 Unless explicitly stated otherwise, all products are manufactured upon order.

3. Product Description
3.1 We take reasonable care to ensure that product descriptions, images, dimensions, and specifications are accurate.
3.2 Colours may vary slightly due to screen settings and lighting conditions.
3.3 All dimensions provided are approximate and may vary slightly due to the handmade nature of our products.

4. Pricing & Payment
4.1 All prices are displayed in GBP (£) and include VAT where applicable.
4.2 Payment must be made in full prior to dispatch unless otherwise agreed in writing.
4.3 We accept major debit and credit cards and other payment methods shown at checkout.
4.4 We reserve the right to amend pricing prior to order confirmation.

5. Delivery
5.1 Free delivery and fitting is provided to ground floor addresses only.
5.2 Deliveries above ground floor incur additional charges:

£40 for the first floor

£10 per additional floor
5.3 It is the customer’s responsibility to ensure:

Adequate access for delivery
-
Furniture will fit through doors, staircases, hallways, and entryways
5.4 If delivery cannot be completed due to access restrictions, incorrect measurements, or insufficient space, the customer will be responsible for return transport costs.
5.5 Risk in the goods passes to the customer upon delivery.

6. Your Right to Cancel (Online & Distance Sales Only)
6.1 If you purchase online, by telephone, or via distance selling, you have the right under the Consumer Contracts Regulations 2013 to cancel your order within 14 days of receiving the goods.
6.2 To exercise your right to cancel, you must notify us in writing via email within 14 days of delivery.
6.3 If you cancel before dispatch, you will receive a full refund.
6.4 If you cancel after dispatch or delivery:

You are responsible for the cost of returning the goods.

The goods must be returned unused and in the same condition as delivered.
6.5 We may make a deduction from your refund for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
6.6 Refunds will be processed within 14 days of receiving the returned goods.

7. Made-to-Measure or Personalised Orders
7.1 Where goods are made to the customer’s specific measurements or clearly personalised specifications, the right to cancel under the Consumer Contracts Regulations 2013 does not apply.
7.2 Customers will be clearly informed at the point of purchase if a product qualifies as made-to-measure or personalised.
7.3 Custom or personalised orders require full payment before production begins.

8. Faulty Goods & Consumer Rights
8.1 Under the Consumer Rights Act 2015, goods must be:

8.2 If goods are faulty, you are entitled to:

A repair or replacement

A refund if repair or replacement is not possible
8.3 Any manufacturing fault must be reported within 14 days of delivery with supporting photographs.
8.4 Normal wear and tear, misuse, accidental damage, or improper care are not considered manufacturing faults.

9. Warranty
9.1 All products include a 12-month manufacturing warranty covering:

Structural components

Foam
9.2 The warranty does not cover:

Fabric wear and tear
-
Accidental damage
-
Damage caused by misuse
9.3 Warranty claims are limited to repair or replacement at our discretion.

10. Delivery Damage
10.1 Any damage must be reported within 48 hours of delivery with photographic evidence.
10.2 Damage caused due to inadequate access space is not the responsibility of Northern Comfort Furniture LTD.

11. Limitation of Liability

11.1 Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence

Fraud or fraudulent misrepresentation

Any liability that cannot be excluded under UK law
11.2 We are not liable for indirect, incidental, or consequential losses.

12. Privacy
We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

13. Intellectual Property
All content on our website, including images, logos, text, and branding, remains the intellectual property of Northern Comfort Furniture LTD and may not be reproduced without prior written consent.

14. Force Majeure
We are not liable for delays or failure to perform obligations due to events beyond our reasonable control, including but not limited to:

15. Amendments

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
